Holds true of decisions by local sheriffs to put their own "tough on immigration" practices in place, like the famous case of Sheriff Joe. I don't like the patchwork on what I view as a national issue. Partly a foreign policy issue.

So if a sanctuary city arrests a guy for drunk driving, and refuses an ICE request to turn that person over, and then that person kills someone while driving drunk subsequently, I can see a case for liability against that city. I understand that Tom and Breitbart like to take spectacular, rare examples and make them seem commonplace, and I know that this is not a widespread problem. But it can happen, and I think that is a risk to which santuary cities could, and probably should, be held to account.
